Ethics Complaint Against Commissioner Robert "Bob" Harrison

Please be advised that Commissioner Robert "Bob" Harrison is an elected official of Madison County of District Six in the state of Alabama. This official is in violation of the Code of Alabama 1975, Code of Ethics for Public officials, employees, section 36-25-5 (A)-Use of official position for personal gain. Commissioner Harrison is the owner of Northwest Huntsville Community Service Organization, Inc. Please note the following:

(1) Around September 19, 2005 Commissioner Bob Harrison opened the doors of his company called Northwest Community Learning Center that is a program under Northwest Huntsville Community Service Organization, Inc. He used state funds to operate this organization for the private benefit of his daughter, Mrs. Lynda Harrison Gaines, who works at the center and is on Madison County payroll. These are acts of pass through funds. Mrs. Gaines acts as if she is a county employee, but she is really a Northwest Community Learning Center employee working for her father, Commissioner Bob Harrison. He did this by acts of fraud and conversion of state funds.

(2) Commissioner Harrison violated the Code of Ethics 36-25-5 (B) and voted on a motion or resolution at eh County Commission meeting to give Northwest Community Learning Center around $20,000 year for educational purposes, which is under the direction of his corporation called northwest Huntsville Community Service Organization, Inc. (Northwest). Commissioner Harrison needed donations from a variety of organizations to meet the requirements of IRS 501 C (3) or (b) with corporate contributions to that are deductible under section 170 C (2) of the Internal Revenue Code, etc. Also this is a violation of the Code of Ethics 36-25-5.

(3) Commissioner Harrison is in violation of the Code of Ethics 36-25-5 (c) by using county employees to work for his corporation (Northwest) which is under his discretion and control and benefits him personally. Commissioner Harrison used county workers to deliver county material and equipment which is public property under his control to his facility that is located at 3404-A blue Springs Road, Huntsville, AL. 35810. The telephone number is (256) 851-7242, fax (256) 858-0983. This property is also paid with county funds and financially benefits his organization and personal interest.

(4) Commissioner Harrison is in violation of Code of Ethics 36-25-5 (d) by using county employers, equipment, facilities, time, materials, human labor, and other public property for his personal private benefit and for his family members and his corporation (narrowest). He set up an operation by using county employees and county employees and county, state funds. The following is a list of county employees illegally working for commissioner Harrison's corporation (Northwest Community Learning Center):

Dr. Olivia Sanders, Cynthia Cotton, Felicia Kaigler, Kecia Lambert, Sara King, Pauline Occomy, Dr. Katie Byrd, Lynda Harrison Gaines, Michelle Young, Carl Fallin (accounting firm), Jo Miley, Diane Kirnes, Tim Easly, and Micheal Lacy work for Northwest and are District Six employees. Commissioner Harrison's organization benefits from all of this as personal gain.

(5) Commissioner Harrison is in violation of the Code of Ethics 36-25-5 (f). He had a substantial financial interest by reason of ownership of Northwest Huntsville Community Service Organization, Inc. and the Northwest Community Learning Center. Commissioner Harrison appeared to be 100% owner of these operations which operated under District Six under Commissioner Harrison's control. the Northwest Board of Directors if controlled by Commissioner Harrison to complete a lot of work for him at District Six and Northwest. Sonji Patterson worked for District Six and also is the President of Northwest Board of Directors. Commissioner Harrison has 100% interest and external control of District Six and Northwest Huntsville Community Service Organization, Inc. and Northwest Community Learning Center. Commissioner Harrison has a conflict of interest that exists between these business entities for personal gain.

In conclusion, Commissioner Harrison has used his position as County commissioner of District Six for personal gain and deceived the voters about the reason and methods why he opened Northwest Community Learning Center. He did not open Northwest for the good of the people or their children, but for his own personal gain buy using tax payer's dollars and equipment, facilities, time, material, human labor and other public property for his private benefit of his family.

Commissioner Harrison should resign as County Commissioner of District Six effectively immediately to preserve the integrity of this office. He should resign to keep some respect of the people that voted for him and to keep from continuing to disgrace this office with his acts of malfeasant.

When Commissisoner Harrison was a candidate for Commissioner, he accused former Commissioner, Prince Preyer, Jr. of the same acts and methods. He also said that he would step down if he did the same thing as Prince Preyer, Jr. We are asking the County Commissioner Chairman to restructure Northwest Community Learning Center under a different entity so that the change would not affect the people it serves until this can be resolved. Commissioner Harrison should not continue to benefit from this situation. All state and county funds should be transferred back to the tax payers of District Six. Commissioner Harrison should be made to pay back over $50,000 of tax payer dollars that were misused for personal gain or they should be paid back from his personal account.

Quid Pro Quo the voters need to know their donations to other 501 (c) organizations by Commissioner Harrison was received and given back to Commissioner Harrison. The accounting firm that Carl Fallin owns manages the budget for both District Six and Northwest Huntsville Community Service Organization, Inc. As a Certified Public Accountant, he cannot be involved in acts of fraud and records will reflect his involvement in these matters. Mr. Fallin is getting paid for his services to District Six and Northwest Huntsville Community Service Organization, Inc. with tax payer dollars. As taxpayer, please look into this situation as soon as possible!
